1. Who we are

These Terms of Use and Service (“these terms”) form an agreement between you and Northview Productions Inc., a British Columbia company doing business as Kalam Di Goonj (“the Company”, “we”, “us”). Kalam Di Goonj (ਕਲਮ ਦੀ ਗੂੰਜ, “the Publication”) is our Punjabi-first digital magazine at kalamdigoonj.com, including its newsletters, PDF editions, audio narration, and any future applications. Our mailing address is Unit 216, 7928 128th Street, Surrey, BC V3W 4E8, Canada. Contact channels are set out in section 18 and on our Contact page.

2. Accepting these terms, and who may use the site

You accept these terms when you create an account, purchase a subscription, or use the site. We record your acceptance expressly at signup and at checkout rather than inferring it from your silence. You must be at least 16 years old to create an account. Anyone may read the free, open parts of the site. If you are younger, or a parent or guardian with questions, see our Minors Notice.

3. Your account

Creating an account requires a valid email address, and you must verify that address before becoming a member. An account is for one person. You are responsible for keeping your password secure and for activity carried out through your account. If you believe someone else has gained access, contact us at [email protected] and we will help you secure it. We offer two account types: a free reader account, and a membership, which is a reader account with an active paid subscription.

4. Membership and patronage (your subscription)

Some writing is open to everyone; the remainder is for members. Membership is patronage (ਸਰਪ੍ਰਸਤੀ) of Punjabi writing rather than the purchase of a fixed body of content. In these terms and at law, your patronage is a paid subscription.

Plans and price. Paid memberships have not started. Kalam Di Goonj is free to read in full today, no plan is on sale, and no payment can be taken. When patronage opens, the monthly and annual prices will be published here in Canadian dollars, and the applicable taxes, the total amount, the renewal terms, and the cancellation method will be shown at checkout before you pay. We will send you a copy of your subscription contract by email within 15 days of any purchase.

Payment. Stripe processes payment. You enter your card details on Stripe’s own secure pages, and those details never reach us.

Automatic renewal. Your subscription renews automatically at the end of each period until you cancel. On a monthly plan you may cancel at any time, and no further period is charged. On an annual plan we send you a renewal notice between 30 and 60 days before each renewal, stating the renewal price and the cancellation method; if you cancel after an annual renewal has been charged, you are entitled to the refund British Columbia consumer law prescribes.

Cancellation. You can cancel at any time from Account → Billing, through Stripe’s customer portal, or by writing to [email protected]. Cancellation always stops future renewals. Your access continues to the end of the current paid period; the time you have paid for remains yours.

Failed payment. If a renewal payment does not succeed, access is not withdrawn immediately. A seven-day grace period begins, during which a notice appears so that you can correct the payment method. If payment has still not succeeded after seven days, member access is suspended, and it resumes when payment succeeds.

Refunds. Our Subscription, Billing, Automatic Renewal, Cancellation & Refund Policy governs billing, renewal, cancellation, and refunds, including your statutory rights under BC consumer law, and forms part of these terms.

5. Reading forms

Punjabi in Gurmukhi script is the original, canonical form of every piece. A piece may also carry an English rendition, a future Shahmukhi rendition, or a narration, but not every piece carries every form. Where a piece is for members, all of its forms fall under the same single membership.

6. Acceptable use

Kalam Di Goonj is licensed to you for your own reading and listening. You agree not to redistribute, reprint, or publicly share member-only writing or audio; not to share your account or password; not to use scraping or automated tools to harvest content in bulk; and not to circumvent the paywall or the site’s security. Sharing a link, using our own share tools, or quoting briefly with attribution is permitted and welcome. You further agree not to use the site unlawfully or to interfere with its operation.

7. Ownership of the writing

All content on the site, including articles, poetry, translations, narration and audio, images, artwork, PDF editions, and design, is protected by copyright and belongs to the Company or to the writers, contributors, and other rights-holders who have licensed it to us. Where a contributor retains copyright in their work, which is our default, publication here means they have granted the Company a licence, not transferred ownership. Your membership grants you a personal, non-transferable right to read and listen for yourself. It confers no ownership of any content and no right of republication.

8. Work you send us

If you send us writing, poetry, photographs, audio, or other work, you retain copyright in it. Our Contributor Submission Terms set out the licence you grant us and the commitments we make in return. Nothing in these terms transfers ownership of your work to the Company.

9. Third-party services and links

We use third-party services to operate the site: Stripe processes payments, Resend delivers our email, and Cloudflare provides our content network and media storage. Each acts under its own terms and privacy policy. None endorses the Publication or is responsible for its content. Our Privacy Policy explains what personal information each one handles. The site may also link to or embed material from other sites. A link is not an endorsement, and external sites are outside our control.

10. Service warranties and their limits

We maintain the site to be reliable and secure, and we hold ourselves to standards of accuracy, fairness, and context, with a published corrections process. Subject to the paragraph below, the site is provided “as is” and “as available”. It may be interrupted for maintenance, may contain errors, and its content may change. We do not warrant that the site will be uninterrupted or error-free.

Your statutory rights are unaffected. Nothing in these terms limits or excludes any right you have under the BC Business Practices and Consumer Protection Act, the Sale of Goods Act, or any other law, to the extent that right cannot be waived or limited by agreement.

11. Limitation of liability

Your non-waivable rights take precedence. This section applies only to the extent permitted by law, and it does not limit our liability for fraud, fraudulent misrepresentation, wilful misconduct, or gross negligence, nor any liability that the law does not permit us to limit or exclude.

Subject to that, the Company’s total liability to you for all claims arising out of or connected with the site, your subscription, or these terms is limited to the amount you paid the Company in the twelve months preceding the event giving rise to the claim, or CAD $50 where you have paid nothing. We are not liable for indirect, consequential, or purely economic loss, including lost profits or lost data, to the extent this limitation is permitted by the law that applies to you.

These terms do not require you to arbitrate, do not remove your right to participate in a class proceeding, and do not restrict you from publishing an honest review of your experience.

12. Your indemnity to us

If your material breach of these terms, for example commercial redistribution of member-only content or an attack on the site’s security, causes a third party to bring a claim against the Company, you agree to indemnify us for losses and reasonable legal costs directly resulting from that breach. This obligation is confined to breaches of these terms. It does not apply to your ordinary use of the site, and it does not apply to the extent a loss results from our own fault. Nothing in this section limits any right you have under consumer protection law.

13. Suspension, termination, and appeals

We may suspend or close an account for a serious breach of these terms, including credential sharing at scale, scraping, paywall circumvention, or unlawful use. Where reasonably practicable we will warn you first and explain the reason. If we terminate your paid subscription for a reason other than your breach, we will refund the unused portion of the period you have paid for. If you consider that we have acted unfairly, you may appeal through our Complaints, Appeals & Right of Reply process. You may close your own account at any time from Account → Close account.

14. Changes to these terms

We may amend the following provisions: the description of site features and reading forms (sections 4 and 5), acceptable use (section 6), third-party services (section 9), our contact details (section 18), and pricing or plan structure for future renewal periods only; together with any amendment required for compliance with the law. If we make such an amendment while you hold an active subscription, we will send notice to your account email stating the new wording, the old wording, and the effective date, at least 30 and at most 60 days before the change takes effect. You may cancel before the change takes effect, without penalty. We do not treat your continued use, by itself, as acceptance of a material change to a subscription contract.

15. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Nothing in this section deprives you of the protection of consumer protection rules of the place where you live, where those rules apply to you regardless of a choice of law.

16. Language

These terms are drafted in English, and the Punjabi (Gurmukhi) summary is provided for accessibility. Where the two differ, the English version governs.

17. General

If any provision of these terms is held invalid, the remainder continues in effect and the invalid provision is replaced by the closest valid wording that reflects its intent. These terms, together with the policies they expressly incorporate, constitute the entire agreement between you and the Company in respect of the site. Provisions that by their nature should survive, namely ownership (7), disclaimers and liability (10 to 12), and governing law and language (15 and 16), survive the closing of your account. You may not assign your account or these terms. The Company may assign this agreement to a successor that carries on the Publication, and we will notify you if it does.
